Extending A Caveat

- "After Receiving A Lapsing Notice"

If you have an interest in land that you tried to protect with a caveat the registered proprietor may serve you with a lapsing notice.

Upon receipt of a lapsing notice your options are to let your interest lapse, to agree for the caveat to be withdrawn or to go about asserting your rights.

Should you wish to assert your rights the first step could be to seek an extension of the operation of the caveat. This will involve an application to the court (if there are grounds) and you may need legal help.

If you would like to extend a caveat, after receiving a lapsing notice, contact us to book a conference to discuss the facts of your case or read more at how to extend or remove a caveat
