Checklist For Injunctions

Often an injunction is sought urgently. For that reason it is helpful to have a checklist handy as to some of the matters that should be considered. 

Typically you would need to: -

  • consider the need for getting an undertaking by writing a cease and desist letter
  • give notice (but not always)
  • prepare the originating process
  • contact the court to foreshadow the application and ascertain any processes to be adopted
  • have the filing fees handy 
  • etc.

Also after the application is made there may be a need to notify the defendant of the orders. Alternatively, if the application does not proceed as planned there may be a need to consider any grounds for appeal and to advise the client as to any applicable time limits.
