Whilst it is tempting to think that most people would properly document arrangements involving expensive assets such as real estate the reality is that it is often something done on a handshake. The reason quite often is because people are tempted to think that because the arrangement is made with a friend or family member there would be no need to put it in writing and therein lies the error. Naturally, in some rare cases family and friends can and often do the right thing but sometimes the wheels come off and it is necessary to look at legal options to address the wrongs. This blog briefly discusses these type of arrangements and some of the legal options to address them.

Whilst NCAT, in its Guardianship Division, can help with a range of legal problems there are certain limitations to what it can do. One important limit is that it cannot assist with the recovery of money or property that was dissipated from a person lacking incapacity. To seek legal redress in such circumstances may require an order from the Supreme Court of NSW rather than to try and ventilate the issue at an application to review a power of attorney, appoint a guardian / financial manager.
